Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Fakeality iOS application (“the app”, “the service”). By using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 16 years old to use Fakeality. The app contains mature themes, situations, and language intended for an older audience.

2. Account

When you first use Fakeality, an account is created for you automatically — no registration is required. Your credits and story progress are tied to this account on your device. You may optionally sign in with Sign in with Apple to access your credits from your other devices; note that if you delete the app without signing in, your credits and progress may not be recoverable. You are responsible for maintaining the security of your Apple ID and for any activity that occurs through your account, and you agree to notify us promptly of any unauthorized access.

3. Service Availability

We aim to keep Fakeality available and working well, but we provide it on an “as available” basis. Features may change or be updated over time, and the service may occasionally be unavailable, slow, or interrupted for maintenance or for reasons outside our control. We may modify or discontinue parts of the service; if we discontinue the service entirely, we will make a reasonable effort to notify users in advance.

4. Purchases and Credits

Fakeality uses credits to generate story content. Credits are sold as consumable in-app purchases, processed by Apple and charged to your Apple Account.

5. AI-Generated Content

Fakeality uses artificial intelligence to generate dialogue, scene descriptions, and other narrative content. You acknowledge that:

7. Intellectual Property

The Fakeality app, its design, code, art assets, story templates, and underlying systems are owned by Connor Kennedy. You may not copy, modify, distribute, or create derivative works without written permission.

Content generated during your gameplay session (your specific story, choices, and resulting dialogue) is provided to you for personal, non-commercial use within the app.

You retain whatever rights you hold in text you enter into the app (custom actions, messages to characters, custom-story fields). By entering it, you grant us a license to store and process that text — including sending it to our AI providers — as needed to generate your story and operate the service.

8. Third-Party Services

Fakeality uses third-party services to provide functionality, including Apple (authentication and payments), Supabase (backend infrastructure), and AI services for content generation — OpenAI, Anthropic, and OpenRouter, a routing service that forwards generation requests to additional AI model providers and vetted hosting partners depending on the model in use. Your use of the app is also subject to the terms and privacy policies of these providers. We are not responsible for the practices or content of third-party services. 9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the app will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy, completeness, or quality of any content generated by the app.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP.

Our total liability for any claims arising from these Terms or the app shall not exceed the greater of the amount you paid us in the past twelve months or $50.

11. Termination

We may suspend or terminate your access to the app at any time, for any reason, including violation of these Terms. You may stop using the app at any time by deleting it from your device, and you may delete your account entirely in the app (Settings → Delete Account).

Upon termination, your account and associated data may be deleted. The provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will continue to apply.

12. Changes to These Terms

We may update these Terms as the app evolves. When we do, we will update the “Last updated” date at the top of this page. Material changes will be communicated through the app. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any disputes arising from these Terms or the app will be resolved in the courts located in New York County, New York.
